<plain_text><page sequence="1">THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. 343 The University of London and the Jewish Historical Society THE TE?ST DEED OF THE GUSTAVE TUCK THEATRE AND MOCATTA LIBRARY, 1932 AN AGREEMENT made the Seventh day of November One thousand nine hundred and thirty two BETWEEN THE UNIVER? SITY OF LONDON (hereinafter called " the University ") of the one part and GUSTAVE TUCK of 33 Upper Hamilton Terrace in the County of London Esquire THE VERY REVEREND JOSEPH HERMANN HERTZ of 48 Hamilton Terrace aforesaid Chief Rabbi DR. MOSES GASTER of 198 Maida Vale in the said County THE REVEREND SOLOMON LEVY of 9 Northfield Road Stamford Hill in the said County and THE REVEREND WALTER LEVIN of 78 Inverness Terrace in the said County being members empowered to sign this Agreement by resolution of the Council of The Jewish Historical Society of England (which was inaugurated at a public meeting held in London on the Third day of June One thousand eight hundred and ninety three and is hereinafter called " the Society ") of the other part SUPPLEMENTAL to an Agreement (hereinafter called " the Principal Agreement ") dated the Sixth day of November One thousand nine hundred and five and expressed to be made between the University College of London of the one part and the Society of the other part WHEREBY IT IS AGREED as follows :? 1. IN this Agreement the following expressions shall have the following meanings that is to say :?? " The Building alterations " shall mean the works of alteration and reconstruction of the buildings of the University at University College London now being carried out by or at the expense of Mr. Gustave Tuck and the plans whereof have already been approved by or on behalf of the University.</page><page sequence="2">344 THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. " The approved plans 99 shall mean the above mentioned plans of the building alterations approved by or on behalf of the University as aforesaid. " The New College Buildings99 shall mean the said buildings of the University at University College when and after the building altera? tions shall have been effected. GROUND FLOOR PLANorLIBRARV and THEATRE. " The Mocatta Collection99 shall mean and include the books prints pictures objects of art and effects now comprised in or constituting or representing (a) the library of books known as the Mocatta Library referred to in Clause One of the Principal Agreement and the museum of Jewish antiquities referred to in Clause Two of the Principal Agreement and the additions to the said library and museum res? pectively which have been made since the date of the Principal Agree? ment other than those that are being presented to the Society by</page><page sequence="3">THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. 345 Mr. Tuck and others for exhibition in the Library and Museum and (b) the collections known respectively as the Herman Gollancz collec? tions and the Israel Abrahams collection and (c) all books prints pictures objects of art and effects from time to time hereafter con? stituting or representing the said premises or which may be added thereto. " The Lucien Wolf Collection " shall mean the books prints pictures objects of art and effects bequeathed to the Society by the Will of Lucien Wolf late of 2 Verulam Buildings Grays Inn in the City of London who died on the Twenty third day of August One thousand nine hundred and thirty. " The new Mocatta Library" shall mean the library museum and rooms intended to form part of the new College buildings and shown on the plan hereto annexed and therein marked " Mocatta Library." " The Gustave Tuck Theatre " shall mean the theatre intended to form part of the new College buildings and shown on the said plan and thereon marked " Gustave Tuck Theatre." " The Society's Room " shall mean the room intended to form part of the new College buildings and delineated on the plan annexed hereto and thereon edged with the colour blue and thereon marked " the Jewish Historical Society's Room." " Kindred Societies" shall mean Societies connected with Jewish History Literature and Research. " The current regulations " shall mean such of the regulations and provisions contained in Paragraphs 3, 4, 8, 9 and 10 of the Schedule to the Principal Agreement as shall for the time being be in force and as for the time being altered or amended under the provisions contained in Clause Six of the Principal Agreement and also the rules made (either before or after the date hereof) under the provisions of Paragraph 11 of the said Schedule and for the time being in force. 2. NOTWITHSTANDING any of the provisions hereinafter in this Agreement contained the Mocatta Collection shall remain and be the property of the University and the Lucien Wolf Collection and the said excepted additions to be exhibited shall remain and be the property of the Society.</page><page sequence="4">346 THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. 3. THE succeeding clauses of this Agreement are conditional on the following provisions being carried into effect on or before the Thirty first day of December One thousand nine hundred and thirty two that is to say:? (a) THE building alterations (which are being effected at the expense of Mr. Gustave Tuck a member of the Society) being duly carried out and completed free of cost to the University and (b) A clear sum of at least Three thousand five hundred pounds being raised by or on behalf of the Society and vested in the University and if either of the above mentioned provisions shall not be duly carried into effect on or before the said Thirty first day of December One thousand nine hundred and thirty two the succeeding clauses of this Agreement shall become and be void and of no effect. 4. FROM and after the completion of the new College buildings the following provisions shall apply and be carried into effect namely :? (a) The Mocatta Collection and the Lucien Wolf Collection shall be usually kept and housed in the new Mocatta Library and Museum which with the Gustave Tuck Theatre shall be under the control of the Management Committee appointed by the University but as to one half of the members always on the nomination of the Society. (b) So long as the Mocatta Collection and the Lucien Wolf Collection shall be usually kept and housed as aforesaid the new Mocatta Library shall be subject to the current regulations and accord? ingly members of the Society or of kindred Societies and members of the University and other persons duly authorised by the University and/or the Society shall be permitted to use the new Mocatta Library and Museum as from time to time permitted by the current regulations and the Society shall have the exclu? sive use of all that room situate and being adjoining the Gustave Tuck Theatre on the first floor of the building of University College Gower Street in the County of London which room is delineated and described on the plan annexed hereto and is thereon edged with the colour blue as their office at all times</page><page sequence="5">THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. 347 at which. University College is open to students and at other times by Agreement. (c) The Society and kindred Societies shall be permitted to use the Gustave Tuck Theatre for meetings of the members of such Societies and their friends as provided by Paragraphs 5 6 and 7 of the said Schedule to the Principal Agreement in regard to the Library and Museum therein referred to or at such other times and on such other terms and conditions (if any) as may from time to time be desired by the Society or any kindred Society and as may be sanctioned by the Managing Committee constituted by Paragraph 3 of the said Schedule to the Principal Agreement either specifically on any special occasion or generally by rules in that behalf made by such the said Committee and approved by the University. (d) The University will occasionally permit the Society to use some other Theatre of the College larger than the Gustave Tuck Theatre if so required by the Society and if any such larger theatre of the University shall be available. (e) The University shall be responsible for the maintenance repair insurance lighting heating cleaning painting and general custody and upkeep of the new Mocatta Library and the Gustave Tuck Theatre and the furniture fittings and fixtures thereof. (/) The rights and privileges hereinbefore provided for the Society and its members and kindred Societies or their members shall be and shall be accepted by the Society in place of and in satis? faction of the rights and privileges of user of the Library and Museum referred to in the Principal Agreement and thereby conferred upon the Society or its members or kindred Societies or their members. (g) All or any of the provisions of the foregoing paragraphs of this Clause may at any time or times be altered or amended or cancelled in such manner as may be agreed between the University and the members (or a majority of the members) for the time being of the said Council of management of the Society.</page><page sequence="6">348 THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. IN WITNESS whereof the University of London has caused its Corporate Seal to be hereunto affixed and the respective parties hereto of the other part have hereunto set their respective hands and seals the day and year first above written. THE FIRST SCHEDULE above referred to. PARTICULARS of the Trusts upon which the said sum of ?3,500 referred to in the above written Agreement shall be held. 1. IN this Schedule the following expression shall have the follow? ing meanings namely:? The expression " the University " and the " Mocatta Collection " and the " Lucien Wolf Collection" and " the New Mocatta Library" and " The Gustave Tuck Theatre " shall respectively have the same meanings as in the above written Agreement. " The original Trustees99 shall mean the University or such other person or persons as the University shall in writing appoint to be the first Trustees for the purposes of this Schedule. " The Trustees 99 shall mean the Original Trustees or other the Trustees or Trustee from time to time for the purpose of this Schedule. " The Trust Fund 99 shall mean the sum of ?3,500 referred to in Clause 3 of the above written Agreement or such other sum as may be paid to the Trustees for the purposes hereof and the investments from time to time representing the same or any part or parts thereof respectively. 2. THE Original Trustees shall invest the said sum of Three thousand five hundred pounds or such other sum as may be paid to them for the purposes hereof forthwith after the receipt of the same in the names of the Trustees in or upon investments for the time being authorised by law for the investment of trust funds and the Trustees may from time to time at their discretion transfer and vary any such investments into or for others of a nature authorised as afore? said. 3. THE Trustees shall hold the trust fund in trust to pay or apply the income from time to time accruing therefrom at the</page><page sequence="7">THE TRUST DEED OF THE GUSTAVE TUCK THEATRE. 349 discretion of the Trustees in or towards payment of the costs and expenses of all or some of the following matters namely:? (a) THE repair maintenance insurance lighting heating cleaning painting and general upkeep and custody of the new Mocatta Library and the Gustave Tuck Theatre and the furniture and fittings and fixtures thereof. (b) THE repairing cleaning renewing restoring and preserving and the maintenance and insurance and custody of the Mocatta Collection and the Lucien Wolf Collection and all other books prints pictures objects of art and other chattels and effects from time to time usually kept in or on or about the new Mocatta Library or the Gustave Tuck Theatre. (c) THE employment and remuneration of any librarians curators and servants and attendants at any time or times employed in or about the new Mocatta Library or the Gustave Tuck Theatre. 4. THE power of appointing New Trustees hereof shall be vested in the University. of :? L.
